
The Netflix series cast doubt on Avery's conviction
A convicted killer in Wisconsin whose legal troubles were dramatized in the television documentary "Making a Murderer" filed motions in the state's appeals court asking to be released on bond, saying he was denied his right to a fair trial.
The filing also points to the replacement of one juror, Richard Mahler, who was dismissed due to a family emergency after the jury had begun deliberations. "Making a Murderer" has inspired petitions to President Barack Obama and Wisconsin Gov. Scott Walker, as well as a critical probe of the country's criminal justice system.
Avery said the county obtained evidence illegally through bad warrants and also tampered with evidence. If the search extended past the parameters laid out by the warrant, than the probe should be ruled illegal and the court proceedings be ruled a mistrial.
Avery was sentenced in 2007 to life in prison for the 2005 murder of Teresa Halbach, a 25-year-old photographer. Zellner has already had quite a lot of high profile clients before, to which it looks forward on adding Avery to its 'long list of wrongful conviction exonerations'. Ken Kratz, the main state prosecutor in the case, told Maxim that the series' directors cherrypicked facts that created an incomplete picture of Avery's conviction.
Meanwhile the only person who could allow Avery a reprieve from prison delivered some disappointing news.
Netflix Avery's trial was made famous by the Netflix documentary "Making a Murderer", which took 10 years to make. At the time of Avery's arrest, he had a $36 million civil lawsuit pending against Manitowoc County for his 18-year imprisonment for a rape he did not commit. He represented himself when he filed the appeal, although he is now being represented by a Chicago-area attorney. Dassey's lawyers argued his confession to authorities was coerced. "I would say in my opinion not guilty".
Aside from Zellner, local counsel Tricia Bushnell will assist as well with the case.
