New Lawsuit Challenges New York State Tampon Tax

Two state lawmakers have proposed legislation that would explicitly add feminine hygiene products to the list of exempt items in New York's tax code, but it hasn't made significant gains toward enactment.

The lawsuit said it was "undisputable that tampons and sanitary pads serve multiple medical purposes" and were a necessity for women's health as they were "used to staunch the flow of menstrual blood and prevent encrustation and detritus".

"Rogaine, foot powder, dandruff shampoo, Chapstick, facial wash, adult diapers, and incontinence pads are not taxed".

We could soon see the end of the controversial tampon tax - well, in NY at least. "There is no way these products would be taxed if men had to use them". The complaint argues that sales tax for tampons and sanitary pads violates state law, which declares that medical items shouldn't be taxed.

The tampon tax is a tax that imposes a 5 percent increase on feminine hygienic products like tampons, pads, and douches, according to the European Union legislator.

They claim the tax is "irrational" and "discriminatory" and said the state should 'return the many millions of dollars they took illegally at the expense of women's health'.

We can debate what necessities are, or how to reform our tax code, but the question before us is whether California should tax women for being women. Sadly, it's recently been revealed that products sold toward women are charged a higher cost than those same items targeted toward men-think razors, deodorant, toys, even clothing.

And now those men, and the rest of the government, need to make the laws that abolish those taxes.
