Mobile County probate judge stops issuing marriage licenses

Despite the US Supreme Court's landmark decision in June 2015, Alabama's chief justice Roy Moore ordered a probate on marriage licenses for gay couples.

Within hours of the administrative order, the probate court in Mobile County said on its website that it was "not issuing marriage licenses to any applicants until further notice".

Jefferson County Probate Judge Alan King says he reviewed the order as well as their attorneys and they have chose to continue issuing marriage licenses to all couples. Gays and lesbians have been getting married in Alabama for almost a full year now, so even if he can throw a temporary wrench in his state's works for now, it's not like he can un-marry all of the couples that are currently enjoying full marriage rights.

What Moore did not mention is that in July, after the Obergefell decision came down, a federal judge in Alabama said that the ruling was binding upon all probate judges in the states.

A federal judge in Alabama also overturned the state's ban on same-sex marriage previous year. Williams added that Moore's order does not affect his county as he has not been issuing certificates since June. The order points out the Obergefell v. Hodges decision only applied to the states named in the case: Michigan, Kentucky, Ohio and Tennessee. In 2003, as Chief Justice of the Alabama Supreme Court, Moore defied a federal judge's ruling to remove a monument of the Ten Commandments from the front of the Alabama Judicial Building, according to a CNN report from the time.

'We need to ensure that marriage equality is guaranteed and enforced nationwide.

Despite Moore's four-page order, his conclusions may not be honored by other judges.

"We don't get to pick and choose what laws we follow", he said.

"No amount of twisted legalese can obscure the fact that Moore should either abide by the Supreme Court's decision or resign".

He was re-elected as Alabama chief justice in 2012.

Judge Moore is an ultra-conservative Christian known for his acts of resistance to federal authority.

Justice Moore previously used an administrative order to try to derail same-sex nuptials in Alabama. "Judge Moore's latest charade is just sad & pathetic", Justice Reed posted on Twitter.
